Partner professionals agreement

Courtesy translation. The French version is the reference text and prevails in case of any difference.

Last updated: October 18, 2026.

This agreement is made between HomeOS (operated by Jovan Leclaire, 383 rue Principale, Saint-Amable, Québec) and the business or self-employed worker (“you”) applying to the HomeOS partner program. By sending your application you declare that you have read it and you accept it.

1. What HomeOS does

HomeOS connects homeowners who request a quote with professionals. HomeOS carries out no work, does not set your prices and is not a party to any contract between you and a client. You remain fully independent: this agreement creates no employment, mandate, partnership or representation between HomeOS and you.

2. Your application

  • You guarantee that the information provided is accurate and you promptly tell us of any change.
  • You hold, and keep in force, the licences and authorizations the law requires for your work, including the Régie du bâtiment du Québec (RBQ) licence for construction work that requires it, as well as civil liability insurance.
  • We check your application (identity, licence, insurance) before approving it. We may refuse, suspend or remove a partner, in particular for false information, an expired licence or insurance, well-founded complaints or a breach of this agreement.

3. How requests (“leads”) work

  • A request is sent by email to professionals of the right trade, chosen automatically based on the city served, the work you tick in your profile, your acceptance rate and client ratings. It is first sent to the 3 best ranked; if nobody takes it within 24 hours, to 3 more, up to 4 sends in total.
  • No more than 3 professionals can take the same request.
  • You first see the trade, city, size of the job, the client's answers and photos. You take the request only if it suits you. By taking it, you see the client's first name, phone number and the address of the work.
  • Taking a request does not guarantee a contract, and HomeOS guarantees no volume of requests.

4. Prices and billing

  • No sign-up fee, no subscription.
  • Your first 3 leads are free. Nothing is due before the 4th lead you take.
  • After that, each request you take is billed according to the size of the job, shown in the email before you take it: small job $15, medium job $45, large job $120, very large job $250 (plus taxes, where applicable).
  • You pay only for the requests you take. If you decline or do not answer, you pay nothing.
  • Billing is monthly. You receive by email a statement of the requests taken, then an invoice with payment terms.
  • The size of a job is determined by the client's answers, according to our categories. We may change our prices or categories: a change applies only after written notice of at least 30 days and never to requests you have already taken.

5. Problem requests

If, after taking a request, you find within 48 hours that it is unusable (for example invalid number, client unreachable, duplicate request, non-serious request), report it from your request page. We review every report fairly and, if it is well-founded, we credit the request. Clients who changed their mind or chose another professional do not give rise to a credit.

6. Your commitments to clients

  • Contact the client quickly and be honest and courteous.
  • Give clear quotes that comply with the law, including the Consumer Protection Act (written contract and estimates required in the cases provided), and carry out the work to professional standards and applicable codes.
  • Apply no undue pressure. Make no false statement about your licences, insurance or your link with HomeOS.
  • You alone are responsible for your work, your contracts, your employees and subcontractors, and any claim arising from them.

7. Client information

  • You use a client's information (name, phone, address, photos) only to answer their quote request. You do not sell it, share it, or use it for marketing or solicitation.
  • You protect it, keep it only as long as needed (quote, contract concluded, legal obligations) and comply with the Act respecting the protection of personal information in the private sector and Canada's Anti-Spam Legislation.
  • If a client asks you to delete their information or stop contacting them, you do so without delay.

8. Ratings

After a request, we ask the client how it went. Their ratings are used to rank professionals and for service quality. We may disregard a manifestly abusive or false rating. You may not ask a client to change a rating or write false ones.

9. Your business information

We use the information in your application (business, name, phone, email, licence, regions, experience) to check your application, send you requests, bill you and ensure the quality of the service. Your business name, trade and licence may be shared with clients whose request you take. See the privacy policy. To access, correct or delete your information: contact@monhomeos.ca.

10. Liability

HomeOS guarantees neither the quality of requests nor that they will lead to a contract. To the extent permitted by law, HomeOS's total liability to you is limited to the amounts you paid us in the 12 months before the event, except for HomeOS's gross or intentional fault. You release us from any third-party claim arising from your work or from your failure to comply with the law or this agreement.

11. Term and ending the agreement

The agreement lasts as long as you are a partner. You may leave at any time by writing to us: you then pay only for requests already taken. We may end it or suspend your profile under section 2, and you may ask for your profile to be paused at any time. Sections that by their nature must continue to apply (client information, billing, liability) survive the end of the agreement.

12. Changes

We may change this agreement. We notify you by email at least 30 days before any important change takes effect. If you refuse it, you may leave the program before that date at no cost.

13. Governing law and language

This agreement is governed by the laws of Québec and the federal laws of Canada that apply there; any dispute falls under the courts of Québec. The parties have required that this agreement and all related documents be drafted in French. An English translation is provided as a courtesy; in case of any difference, the French version prevails.
